Terms of Sales (Applicable since January 1, 2016)

The site does not allow online payment. Upon validation of your order you will receive a RIB for the payment of the said order. Upon receipt of your payment, your order will be prepared in 6 weeks, unless we inform you of the deadline. In case of delivery, delivery time will be extra.

Order cancellation :

As soon as your payment is made you can cancel your order for 7 days subtracted from 25 euros for administrative processing, from the 8th day 100% of the sum of your order will remain acquired.

Repayment :

Our products are manufactured at the request and on order of each: No refund is possible.

Reminder of the text of the law of the right of withdrawal:

L.221-19 of the Consumer Code, the customer has a period of 14 days from the day of receipt of the goods to exercise his right of withdrawal and a period of 14 days from the exercise of its right of withdrawal to return the products in their original packaging and intact. If this period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day. The right of withdrawal can be exercised by the customer without having to justify reasons or pay penalties, with the exception of any return costs. Order change:

The document generated by the site’s configurators, and which you receive in copy by e-mail, is your order reference. For any changes you will need to reconfigure your color and material choices – Requests made otherwise for partial changes to your order will not be accepted. Order changes are possible for 14 days after validation of the said order (Excluding express manufacturing request

Validation of orders:

For a product to be put into production, we (XAW France) must have received the order via the website (www.xtremaerialwear.com), your measurements and 100% of the payment. Without these 3 elements no production date can be confirmed.

Upon receipt of the 3 elements allowing the validation of the order, the production time will be 8 weeks unless otherwise informed by us. In case of payment of the “rush” option, the production time will be shortened to 4 weeks. The departure date will be the date of payment of the order. Delivery time should be added to production time.

Taking measurements :

The measurement is under your responsibility if you do it by your own means. We check them, if necessary we will ask you to take measures. In the event of incorrect measurements on your part, delivery costs and modification costs will be at your expense. Minimum package of 50 euros excluding tax – Amount of work on estimate on the basis of 40 euros excluding tax per hour.

If the measurements were taken by a representative of XAW France, a measurement error is found, we will not charge repair costs – Only shipping costs will be requested.

After a past skydiving season, and the use of the product or suit received, XAW France reserves the right not to accept a repair or an adaptation.

To validate the payment of a repair or adaptation of a product or combination received, the following procedure must be followed: By email to the address contact@xawfrance.com, please send photos of the product or suit worn, photos of the full foot from the front and back and a photo showing the problem observed or to be improved. Upon receipt of the photos, XAW France will respond to you by e-mail on whether or not to pay for a potential repair or adaptation requested, or will send you the price requested to respond to your request. Shipping costs will remain at your expense.

Billing:

Payment of invoices upon receipt, any delay will result in a legal penalty of 10% on the amount including tax due from the date of the invoice. Late payment penalties are automatically due on the day following the payment date mentioned on the invoice without the need for a reminder (Art L 441-6 of the Commercial Code).

XAW logo embroidery:

None of our wetsuits will be marketed without our brand logo.

Unless otherwise requested, the colors of the logos will be in line with the colors of the suit, and embroidered in two colors, unless otherwise specified, the choice of colors and location will be made by the XAW France team.

Paid Options:

Material: The choice of Nylon or Cordura multiplies our work because we double these materials for your comfort. This option is passed on to certain part of the configurators (Choice of materials for the Torso and Torso/Panties) for example for the jumpsuits, or on the Lower legs for all the configurators. This option is either 10 euros or 20 euros extra, it will be applied for any part requested in Nylon, Cordura.

Pre-assembly: When the wetsuit (or your product) is sent to you, the seams are not made definitively. The purpose of this option is to adjust the suit (or the product) to your physique – We offer you a virtual appointment a video messaging service to do with this adjustment, chalk and pins are necessary. Following this appointment, you send us the wetsuit (or the product) again at your expense, we sew it definitively taking into account the adjustments made together, and we send you your finished wetsuit (or the product). The final reception time of your wetsuit (or the product) will depend on the time it takes you to set up the virtual appointment and will depend on the time to post the wetsuit (or the product) following the pre-assembly done together.

The wetsuit or the pre-assembled product cannot be used during a jump or in the wind tunnel before the final seams. If you do so and the product is damaged, we will charge for the parts to be changed or any costs related to this misuse.

If you decide to sew our pre-assembled products yourself or through a seamstress, we will no longer ensure the final sewing of your order. If you ask us and your sewing action adds additional work to us, you will be billed for this working time. (on estimate on a basis of 40 euros HT per hour)

Addition of embroideries and/or Patches: The choice of colors and locations of the embroideries and/or Patches will be decided by the XAW France teams. There can be no non-conformity of an embroidery location or the colors used for the realization of this one.

Upon receipt of your products, you should know that:

-A suit or jumping pants can be tried out with a harness bag.

-The product you just received is brand new, it will stretch with use. To find out if it suits you, do about thirty jumps with the product worn.

-The products are manufactured to allow the wearing, underneath, of thin technical clothing.

-Machine wash at 0 or 30 degrees. No dryer. Do not use an iron. Dry it on a hanger.

-The color resistance of our products is tested and verified by our manufacturers, however we recommend that the first wash be done alone, even more so if the main color of your product is red or white.

Repairs or rework:

All products, wetsuits or other jumping clothes that will be brought to us dirty, i.e. not taken out of the washing machine, will either be returned to you without the repairs or resumptions requested having been made or they will be washed before intervention and a charge of 5 euros will be required for this treatment of your worn clothes.

In the event of repair or recovery, we must first receive photos of you wearing the product attached to an explanatory and detailed e-mail of your request or one so that we can meet you at our workshop with your product to see for ourselves what there would be to resume. After validation of our acceptance to rectify the product, the intervention time will be between 8 and 10 weeks.

If, between the measurement and the delivery of your wetsuit (or other product), you have either gained or lost weight and you have not notified us by e-mail, XAW France cannot be blamed. A rectification could, possibly, be proposed on estimate.

After a past skydiving season, and the use of the product or suit received, XAW France reserves the right not to accept a repair or a return (date of delivery versus date of receipt of the first e-mail received by XAW France)

Return shipping costs after repair are the responsibility of the customer.

“First-Timer” suits (exclusively for wind tunnels):

By “first timer” suit, we mean suits exclusively used by wind tunnel customers coming to discover wind tunnel flight.

Upon receipt of specifications by the customer, XAW France will publish an estimate detailing the characteristics and options. After receipt of payment, production will be carried out and no more changes can then be made.

The delivery time will be defined during the validation of the order.

The Minimum Order will be 50 suits, minimum 10 per standard ready-to-wear size.

Orders are made to order and cannot be returned for exchange.

As soon as the suits are used in a wind tunnel, it will not be possible to claim a manufacturing defect. As well as if the suit is diverted from its sole use, no claim can be accepted.

Management of personal data:

The information collected about you is essential to respond to your requests for information, making appointments, delivering your orders. They are exclusively intended for XAW France for the purposes of surveys, analyses, institutional communications or, if you agree, commercial proposals. This information is confidential and kept by XAW France. Applicable right :

These conditions are subject to French domestic law. The language of the conditions is the French language. In the event of a dispute, the French courts will have sole jurisdiction.
